Privacy policy

This policy applies to personal information collected through this website, our inquiry and booking forms, email and telephone correspondence, client galleries, and the provision of photography services (collectively, the “Services”). It does not apply to third-party websites, platforms or services that we do not control, even where we link to them.

We operate in British Columbia, Canada and handle personal information in a manner intended to align with the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation. Nothing in this policy is a legal opinion or a warranty of compliance with the law of any other jurisdiction.

We collect only what we need in order to respond to you and deliver the Services:

• Information you give us. Name, email address, telephone number, event or session date, session type, and the contents of any message, questionnaire response or correspondence you send.
• Booking information. Selected service, requested date, deposit and payment status, and scheduling notes required to hold and fulfil your booking.
• Newsletter information. Your email address and the date and source of your subscription.
• Photographic information. Images, video and audio captured during a session, which may include images of you, your family, guests, pets and property.
• Technical information. Limited device, browser, approximate location and usage data generated automatically when you visit the site, used for security, diagnostics and to keep the site working.

We do not intentionally collect sensitive categories of information, and we ask that you not send us medical, financial account, government identification or other sensitive details unless we specifically request them for a documented purpose.

Deposits and payments are processed by third-party payment providers. Where a payment provider is used, your full card or banking details are submitted directly to that provider and are not collected, viewed or stored by us. We receive only limited confirmation data such as amount, currency, date, status and a transaction reference.

• To respond to inquiries, prepare quotes and confirm availability.
• To create, administer and fulfil bookings and contracts, including scheduling and deposits.
• To capture, edit, deliver and archive the photographs you have engaged us to produce.
• To send service-related messages such as confirmations, reminders and gallery delivery.
• To send marketing or newsletter emails where you have consented, with an unsubscribe option in every message.
• To operate, secure, troubleshoot and improve this website.
• To keep business records and to establish, exercise or defend legal claims, including tax and accounting obligations.

We rely on your consent, the performance of our contract with you, and our legitimate business interests as the basis for these uses. Where consent is the basis, you may withdraw it at any time, subject to legal and contractual restrictions and reasonable notice; withdrawal does not affect processing already carried out.

All photographs delivered by McManus Photography are copyrighted works and remain the exclusive property of the Studio. They are licensed to clients only under the limited terms set out in our Terms of Use and signed session agreement. No right to copy, distribute, resell, edit, publish, or commercially use any image is granted by delivery or display.

Our signed session agreement governs whether images may be displayed publicly as part of our portfolio. Where that agreement permits portfolio use, images may appear on this website, in social media, in printed samples, in awards or publication submissions, and in advertising for the studio. That display is our own editorial and promotional use of our copyright property, not a grant of any right to others.

If you prefer that your images remain private, tell us in writing before or after your session and we will not publish them. Where images have already been published, we will remove them from surfaces we control within a reasonable period; we cannot recall copies already downloaded, reshared, printed or cached by third parties, and we accept no liability for such copies.

We do not sell, rent or trade personal information. We share it only as needed with service providers that help us operate, and only for the purposes we specify. These may include website and database hosting, email delivery, calendar and scheduling tools, payment processing, cloud backup and image delivery, and professional advisors such as accountants or legal counsel.

Some of these providers may store or process information outside British Columbia or Canada, including in the United States. Information held in another jurisdiction may be accessible to the courts, law enforcement and national security authorities of that jurisdiction. By using the Services, you acknowledge this transfer.

We may also disclose information where required by law, court order, subpoena or lawful request by a public authority; where necessary to investigate suspected fraud, abuse or a security incident; or in connection with the sale, merger or transfer of the business, in which case the recipient will be bound by terms no less protective than this policy.

This site uses the cookies and local storage necessary to operate — for example, to keep you signed in to an administrative session or to remember a dismissed notice.

We also use two measurement tools. Google Analytics (via Google Tag Manager) collects anonymized usage statistics such as pages visited and approximate region, which helps us understand how the site is used. The Meta Pixel (provided by Meta Platforms, Inc.) records page views and when a visitor submits an inquiry, so we can measure whether our advertising on Facebook and Instagram leads to genuine inquiries. These tools may set cookies and transmit your IP address and browser information to Google and Meta. No inquiry form contents are shared with these platforms.

Most browsers allow you to block or delete cookies, and browser extensions or your device settings can opt you out of this measurement; doing so may affect how parts of the site function. Where the law requires consent before these tools run, we will request it.

We keep personal information only as long as reasonably necessary for the purposes described above or as required by law. Inquiry records are typically retained for up to two years, contract, booking and financial records for at least seven years to meet Canadian tax and limitation-period requirements, and newsletter records until you unsubscribe. Final edited images may be archived indefinitely as part of our portfolio and business records unless your agreement provides otherwise. Delivery galleries are not a permanent archive and may expire; you are responsible for downloading and backing up your images.

We use administrative and technical measures proportionate to the sensitivity of the information we hold, including access controls on administrative accounts, transport encryption on this website, database access rules limiting records to authorized users, and reputable third-party hosting and backup providers.

No method of transmission or storage is completely secure. While we take reasonable steps to protect your information, we cannot and do not guarantee absolute security, and we expressly disclaim any such guarantee. You are responsible for keeping any gallery or account credentials confidential and for notifying us promptly of suspected misuse.

• Access — request confirmation of what personal information we hold about you and a copy of it.
• Correction — ask us to correct information that is inaccurate or incomplete.
• Deletion — ask us to delete information we no longer need for a lawful or contractual purpose.
• Withdrawal of consent — ask us to stop marketing emails or portfolio use of your images.
• Complaint — raise a concern with us, and with the Office of the Privacy Commissioner of Canada or the BC Office of the Information and Privacy Commissioner if unresolved.

Send requests to mallory@mcmanusphotography.com. We will respond within the time required by applicable law. We may need to verify your identity before acting, and we may decline or limit a request where the law permits — for example, where records must be retained, where the information relates to another identifiable person, or where a request is frivolous, vexatious or unduly repetitive.

This website is not directed to children, and we do not knowingly collect personal information directly from anyone under the age of majority. Where a session involves minors, information and photographic consent are provided by a parent or legal guardian, who confirms they have authority to give that consent on the child’s behalf.

Links to third-party sites are provided for convenience only. We do not control and are not responsible for the content, privacy practices or security of those sites, and your use of them is governed by their own terms and policies.

We may update this policy from time to time. The revised version takes effect when posted, and the effective date above will change. Material changes affecting how we use information already collected will be communicated by email or a notice on this site where required. Your continued use of the Services after posting constitutes acceptance.
